Illegal immigrant ICE wanted to deport now is accused of wife's stabbing death

The federal immigration authorities say that Oregon authorities prevented them from detaining an illegal immigrant from Mexico who is now accused of the brutal death by stabbing his wife, whose body was found in a ditch on Sunday.

The case marks the latest dispute between federal authorities and Oregon over the state's "sanctuary" laws regarding illegal immigrants.

The suspect, identified as Martin Gallo-Gallardo, 45, had been released in March by the Multnomah County Sheriff's Office after prosecutors dismissed the assault charges against him. His wife and daughter stopped cooperating and a grand jury refused to accuse him. FOX 12 Oregon reported.

The body of his wife, Coral Rodriguez-Lorenzo, 38, of Portland, was found near the Sandy River in the Bull Run-Sandy area east of Portland. She had been stabbed several times, authorities said.

Gallo-Gallardo was arrested this week and charged with murder, according to an affidavit.

Officials of Immigration and Customs Enforcement (ICE) said the federal agency placed a civil hold warehouse in Gallo-Gallardo while in custody in Portland so that he could begin the deportation process. The agency said the sheriff's department did not comply with the request because of state sanctuary laws.

"It is regrettable that law enforcement agencies such as the Multnomah County jail refuse to work with ICE to promote public safety by holding criminals accountable and providing justice and closing their victims," said Tanya J. Roman, spokesperson for the ICE regional office covering Oregon, Washington, Idaho and Alaska. "

Multnomah County officials said Friday they never received the ICE request, adding that a 2014 federal court decision prevented them from recognizing civil detention requests.

"The US Attorney's Office knows this, ICE knows it, but they persist in following this failed strategy," said Multnomah County officials.

Multnomah County Sheriff Mike Reese said Friday that the request for dismissal by fax to your office by ICE resulted in an error message in the transmission.

"We're going to start using good technology," he said.

The case highlights the controversial immigration sanctuary law of Oregon, adopted in 1987, which prevents law enforcement authorities from illegally detaining people in the country who have not violated any other law. The voters of Tuesday will decide if they repeal the law, OregonLive.com reported.

"The county's statement on this issue ignores the fact that there is no mechanism for a judge to issue a criminal warrant for an administrative immigration arrest. The Oregon sanctuary policies do not recognize the processes set by the federal government to enforce the immigration law, and they do it in the cost of the security of its citizens ", according to ICE.

Reese is opposed to repealing the law of the sanctuary, saying in a recent television ad that "helps create bright lines for the application of local law," the Informed daily call. "The communities we serve know that we are focused on protecting and serving them, we are not worried about their immigration problems."

In addition, if ICE wanted to arrest Gallo-Gallardo, his agents could have picked him up during the six months he was released before his subsequent arrest for allegedly murdering Rodriguez-Lorenzo, a spokesman for the sheriff's department said.

"They had his name, address and telephone number," said the sergeant. Brandon White, a spokesperson for the Multnomah County Sheriff's Office. "It is false to make this claim when they did not follow the process even to enter the information of the civil responsible in any database of the law."

The court documents the state Gallo-Gallardo took his wife to nearby Clackamas County after an argument and stabbed her several times. He pleaded not guilty to the crime on Tuesday.
