In March 2015, it was publicly disclosed that Hillary Clinton, during her tenure as Secretary of State of the United States, had exclusively used her family's private email server for official communications, instead of the official email accounts of the Department of State maintained in federal servers. Those official communications included thousands of emails that would then be marked as retroactively classified by the State Department.


The controversy developed in the context of the Clinton presidential election campaign of 2016 and the hearings held by the Select Committee of the United States House over Benghazi. Some experts, officials and members of Congress have argued that their use of the private messaging system software and a private server violated the protocols and procedures of the Department of State, as well as the federal laws and regulations that govern record keeping. In response, Clinton said his use of personal email complied with federal laws and State Department regulations, and that former secretaries of state had also maintained personal email accounts, though not their own private email servers. .


After raising the allegations that some of the emails in question contained classified information, the Federal Bureau of Investigation (FBI) initiated an investigation into how the classified information was handled on the Clinton server. 113 emails contained information that was classified at the time it was sent, including 65 emails considered "Secrets" and 22 considered "Top Secrets". Three contained marks indicated that they could be classified, although they lacked classified headings and were only marked with a small "c" in parentheses, described as "portion marks" by FBI Director James Comey.
