Travel to New Zealand? Refusing to unlock your smartphone could lead to a considerable fine
.CANBERRA, Australia (AP) - Visitors to New Zealand can receive a fine of NZ $ 5,000 ($ 3,243) for refusing to provide passwords to unlock electronic devices and allow customs officials to examine them under a new law that a group of Civil liberties condemned on Thursday as A serious invasion of privacy.
The law entered into force on October 1 as part of an update of the 22-year customs legislation. It also gives customs officials the authority to copy the data found in the searched devices.
"It is unlikely that the traveling public will notice a big difference on the border," the New Zealand Customs Service said in a statement last week.
But the New Zealand Civil Liberties Council said the law gives customs officials the power to force travelers to unlock their smartphones without justification and without legal options for travelers to challenge an order to enter a password.
"Modern smartphones contain a large amount of highly confidential private information, including emails, letters, medical records, personal photos and very personal photos," council spokesman Thomas Beagle said in a statement.
"Allowing customs to demand the right to examine and capture all this information is a serious invasion of the personal privacy of both the person who owns the device and the people with whom it has been communicated," said Beagle.
Beagle questioned whether the intrusion would catch the criminals, who would prefer to pay the fine than expose the evidence that could lead to prison.
Criminals could also store their data in the cloud, travel with a deleted phone and restore data once they pass through customs, he said.
