The Secretary of Commerce, Wilbur Ross, can not be questioned in lawsuits that question his decision to add a question of citizenship to the 2020 census, the Supreme Court ordered.
(AP, Archive)The Supreme Court issued an order Monday night blocking the interrogation of Commerce Secretary Wilbur Ross in relation to the lawsuits challenging his decision to add a citizenship question to the 2020 census.
A federal court in New York had ruled previously that Ross's interrogation could proceed as part of a dozen large states and cities. The plaintiffs claim that the question will discourage immigrants from participating, diluting political representation and federal dollars for states that tend to vote for Democrats.
The US District Judge UU., Jesse Furman, had based his decision on Ross presenting a statement about concerns about Ross' veracity by relating how the decision to add the citizenship question came about. The judge said Ross said in March, when the decision to add the question of citizenship was announced, which he considered adding after a request to do so last December from the Justice Department.
"The record developed so far, however, casts serious doubts about these claims," the judge wrote in September.
However, earlier this month, Justice Department lawyers filed a new document in the case in which Ross said he now remembers talking to former White House chief aide Steve Bannon in the spring of 2017. on how to add the question. In the recent court appearance, federal government lawyers said Ross recalled that Bannon called him in the spring of 2017 to ask him if he would speak with Kansas Secretary of State Kris Kobach about Kobach's ideas about the possibility to add a question of citizenship to the census.
The lawyers wrote that Ross also discussed adding the question to Attorney General Jeff Sessions in the spring of 2017 and other times.

The administration has argued that Ross's questioning would be inappropriate. The same session went into the subject last week when he said in a speech by the Heritage Foundation that Furman's order represented an improper attempt "to hold a trial on the inner workings of the mind of a cabinet secretary" .
The Supreme Court allowed the deposition of Acting Assistant Attorney General, John Gore, to move forward, on the dissidence of Judges Neil Gorsuch and Clarence Thomas.

The trial is scheduled to begin in New York on November 5, although Gorsuch suggested in a four-page opinion that Furman could delay the proceedings. Gorsuch said he "sees no reason to distinguish between Secretary Ross' deposition and those of other senior executive officials."
The Ross court order will remain in effect indefinitely, assuming the administration will file a more complete appeal to the judges within a week.
