The failure of Monsanto Weed Killer is the first step in a long legal battle

With his actions falling and more lawsuits expected, Monsanto promised on Tuesday to go ahead with a nationwide legal defense of its best-sealing Roundup after a judge in San Francisco confirmed a verdict alleging it causes cancer.

Legal experts said the decision will have little value in courts across the country where similar cases are pending but will likely lead to more lawsuits. Similar lawsuits doubled from 4,000 to 8,000 after a San Francisco jury awarded gardener DeWayne Johnson $ 389 million in August.

Monsanto's lawyers said they will fight Johnson and any other lawsuit in the country alleging that the active ingredient in the world's most popular herbicide, glyphosate, causes cancer. Johnson's lawsuit was the first to go to trial, and several more appear ready to begin early next year.

Judge Suzanne Bolanos reduced the jury prize for Johnson to $ 78 million on Monday, but confirmed her verdict against Monsanto, based in St. Louis.

She reduced the punitive damages from $ 250 million to $ 39 million in a brief decision that contrasted with a previous tentative ruling that said she doubted that Johnson should receive such a prize.

Bolanos said earlier that Johnson's lawyers could not prove that Monsanto executives acted with malice, which is required for punitive damages. She did not explain her change of opinion. Several jurors wrote to the judge asking him to respect his verdict, but legal experts said that should not have influenced the judge.

Monsanto's lawyer said he would appeal the decision if Johnson accepts the award instead of asking for a new trial. You have until December 7 to decide.

Monsanto argues that numerous scientific studies and the US Environmental Protection Agency. UU They have found that glyphosate is safe.

"Because of this, we will continue to vigorously defend our glyphosate-based products," said company spokesman Daniel Childs.

Johnson's attorney argued that the World Health Organization in 2015 concluded otherwise.

Legal experts say San Francisco's decision will not have an immediate legal effect on the other lawsuits, especially because they predict months, if not years, of appeals.

A decision of the San Francisco court of first instance is also not binding in any other court. The decisions of the California courts of appeals are binding in the courts of California, but not in the actions of state courts elsewhere.

"It's just one of the first pieces of a big legal puzzle," said David Levine, a law professor at the University of California at Hastings.

Levine said the company will not consider resolving any lawsuit until enough decisions of the trial court are accumulated. "There just are not enough data points to make a decision," he said.

The German company Bayer Ag bought Monsanto, based in San Luis, in August for $ 63 billion. Its stock price fell 8.6 percent per share on Tuesday.

"Clearly, this issue will not go away," UBS analyst Michael Leuchten wrote in a note to investors on Tuesday.
