(Reuters) - Shares of Tesla Inc (TSLA.O) jumped almost 18 percent on Monday when Chief Executive Elon Musk settled a lawsuit that threatened to drive him out and said an increase in third-quarter production had pushed him to the edge of profitability.
Tesla fans applauded the signs of a jump in manufacturing, while business analysts said the company needed to live up to the spirit of the deal by appointing a strong independent president and new directors.
The electric car maker's stock sank last week after the US Securities and Exchange Commission accused Musk of securities fraud and tried to ban him from leading the company, which points to a long struggle that it could have undermined Tesla's operations and ability to raise capital.
Instead, under an agreement announced at the weekend, Tesla and Musk will pay $ 20 million each to the regulator and Musk will no longer be president, but will continue as executive director, holding in place one of the best known corporate figures. of the United States.

The relief in the resolution of the demand generated the biggest one-day gain in Tesla shares in more than five years.
"Stocks went down a lot on Friday because it was not clear if they would stay in the company, given what the SEC was pushing," said Garrett Nelson of CFRA Research.

Musk has won legions of fans for his bold approach to business and technology, using his 23 million Twitter followers to promote Tesla, his SpaceX rocket company and the tunnel company Boring Co.

As part of the agreement with the SEC, Tesla will also appoint an independent chairman and two independent directors, answering calls on Wall Street to ease pressure on Musk and provide more balance in the automaker's management.
"This is one of the best cases to name an independent president that we have seen in a long time," said Courteney Keatinge, research director for Glass, Lewis & Co.'s proxy advisor.
"His behavior has not been good for a while, and I think that this type of behavior has a domino effect, when there is no stable leadership at the top."
The lawyers said the agreement and the size of the fine could give more ammunition to street vendors pursuing separate cases against Musk for manipulating the company's stock until Aug. 7, as well as a Department of Justice investigation.
But several experienced litigants also said that, while the DOJ investigation is separate, the SEC agreement could mark the end of the official action against Tesla and Musk.
"The test standard for any potential criminal charge is higher than that of a civil case, which the SEC had," said Jay Dubow, a former branch chief in the SEC's enforcement division.
"The DOJ investigation may not result in criminal charges, at least in part because the DOJ could determine that the SEC action resolved the matter and that no further government action is required."
Musk and Tesla either admitted or denied the SEC's findings under the agreement, which must still be approved by a court.
