Supreme Court could limit execution of people with dementia
The Supreme Court seems willing to extend the protection of capital punishment to people with dementia who can not remember their crime or understand the circumstances of their execution.
The judges heard the arguments on Tuesday in the case of Alabama jail inmate Vernon Madison. He killed a police officer in 1985, but has suffered attacks that, according to his lawyers, have left him with severe dementia.
The high court has previously said that the constitutional prohibition of cruel and unusual punishments means that people who are crazy, delirious or psychotic can not be executed.
A decision for Madison would likely mean a new hearing in state court, not a determination that rules out his execution.
Presidential Judge John Roberts and the four liberal judges of the court seemed more willing to govern by Madison.
