Federal appeals court judges ruled last month that Missouri can impose a requirement that doctors must have admission privileges at nearby hospitals before they can perform abortions. The judges issued a mandate on Monday for that rule to take effect officially.

Planned Parenthood attorneys asked US District Court Judge Brian Wimes to temporarily waive the Columbia clinic of the requirement by Wednesday. Wimes has not yet ruled on that request.


If Wimes decides to grant a temporary restraining order to the law, the abortions could be resumed in the clinic.


Planned Parenthood affiliates with Missouri health centers filed an underlying lawsuit to block state requirements for admission of privileges and mandates for clinics to meet hospital standards. The Supreme Court of the United States in 2016 overturned similar rules in Texas.


US District Judge Howard Sachs issued a temporary restraining order to block the admission privilege rule in May 2017. But his action was dismissed in September by the judges at the 8th Circuit Court of Appeals. The United States, who argued that Sachs did not do enough to weigh the cost benefits of the Missouri rules and returned the case to the lower court.


The underlying challenge to Missouri's abortion regulations is still pending.
