I am an independent and impartial judge


I felt honored to be in the White House on July 9 with my wife, Ashley, and my daughters, Margaret and Liza, to accept the nomination of President Trump to succeed my former boss and mentor, Judge Anthony Kennedy, in the Supreme Court. My mother, Martha, one of the first women to serve as prosecutor and trial judge in Maryland, and my inspiration to be a lawyer, sat in the audience with my father, Ed.


That night, I told the Americans who I am and what I believe. I spoke about my 28-year career as a lawyer, almost all of whom have been in public service. I talked about my 12 years as a judge in the US Court of Appeals. UU For the Circuit of the District of Columbia, often called the second most important court in the country, and my five years of service in the White House for President George W. Bush. I spoke about my long history of advancement and promotion of women, including as a judge, most of my 48 law clerks have been women, and as a coach of girls' basketball teams for a long time.


As I explained that night, a good judge must be an arbitrator, a neutral and impartial arbitrator who does not favor any political party, litigant or politician. As Judge Kennedy has stated, judges do not make decisions to achieve a preferred outcome. The judges make decisions because the law and the Constitution oblige the result. During the past 12 years, I have sometimes ruled for prosecution and others for defendants, sometimes for workers and sometimes for companies, sometimes for environmentalists and sometimes for coal miners. In each case, I followed the law. I do not decide cases based on personal or political preferences. I am not a pro-plaintiff or pro-defendant judge. I am not a pro-prosecution or pro-defense judge. I am a pro-law judge.


As Judge Kennedy showed us, a judge must be independent, not influenced by public pressure. Our independent judiciary is the jewel in the crown of our constitutional republic. The Supreme Court is the last line of defense for the separation of powers and for the rights and freedoms guaranteed by the Constitution.


The Supreme Court should never be seen as a partisan institution. The judges do not sit on opposite sides of a hallway. They do not meet in separate rooms. As I have said repeatedly, if confirmed before the court, I would be part of a team of nine people, committed to deciding cases in accordance with the Constitution and the laws of the United States. I would always strive to be a team player.


During the confirmation process, I met with 65 senators and explained my approach to the law. I participated in more than 30 hours of hearings before the Senate Judiciary Committee, and submitted written responses to almost 1,300 additional questions. I was grateful for the opportunity.


After all these meetings and after the conclusion of my initial hearing, I was subject to unfair and, sometimes, vicious accusations. My time in high school and college, more than 30 years ago, has been ridiculously distorted. My wife and daughters have faced vile and violent threats.


In that context, I testified before the Judicial Committee last Thursday to defend my family, my good name and the public service of my life. My auditory testimony was strong and passionate. That's because I denied the accusation against me energetically and passionately. At times, my testimony, both in my opening statement and in response to questions, reflected my overwhelming frustration at being wrongly accused, without corroboration, of horrible behavior completely contrary to my history and character. My statement and responses also reflected my deep anguish over the injustice of how this claim has been handled.


Last Thursday I was very excited, more than ever. It could have been too emotional at times. I know my tone was sharp, and I said some things that I should not have said. I hope everyone can understand that I was there as a son, husband and father. I testified with five main people in my mind: my mom, my dad, my wife and, above all, my daughters.


In the future, you can count on me to be the same type of judge and person I have been throughout my 28-year legal career: hard-working, impartial, open, independent and dedicated to the Constitution and the public good. As a judge, I have always treated my colleagues and litigants with the utmost respect. I have been known for my courtesy inside and outside the bank. I have not changed. I will continue to be the same type of judge I have been for the past 12 years. And I will continue to contribute to our country as a coach, volunteer and teacher. Every day I will try to be the best husband, dad and friend I can be. I will remain optimistic, on the sunrise side of the mountain. I will continue to see the coming day, not the day it left.


I respect the Constitution. I believe that an independent and impartial judiciary is essential for our constitutional republic. If confirmed by the Senate to serve on the Supreme Court, I will keep my mind open in all cases and will always try to preserve the Constitution of the United States and the rule of law in the United States.


Judge Kavanaugh has been nominated as an associate judge of the Supreme Court of the United States.
