(Reuters) - A Florida city commissioner was arrested and charged with second-degree murder for shooting a man he suspected was trying to steal an ax from his military surplus store, officials said on Saturday.


Michael Dunn, a commissioner in the city of Lakeland between Tampa and Orlando, was acting in self-defense, his lawyer told local media. Florida's "defend your territory" law eliminates the legal responsibility to withdraw from a dangerous situation and allows the use of lethal force when a person feels very threatened.

But prosecutors rejected that explanation for the October 3 shooting and Dunn was arrested at his lawyer's office late on Friday, Lakeland police spokesman Gary Gross said in an email.


Brian Haas, Florida's 10th district state prosecutor, told a news conference Friday that a grand jury indicted Dunn on a second-degree murder charge.


Second-degree murder is less serious than first-degree murder because it does not imply an allegation of pre-meditation. In Florida, a person convicted of the crime still faces a possible maximum sentence of life imprisonment.

Haas told reporters he found that Dunn's actions were not justified by Florida's "defend their territory" legislation.


A Dunn lawyer could not be reached for comment on Saturday.


The victim, Cristóbal López, 50, had entered the store with his father. Dunn saw that Lopez was hiding an ax and asked if he planned to pay for it, police said in a statement the day after the shooting.


In the filming of a store security camera that went public, Lopez is seen trying to leave with the ax, while Dunn tries to pull him by the shirt with one hand and points a gun with the other. Dunn then shoots Lopez, who falls to the ground.
