Exclusive: US senators UU They urge India to soften the position of data localization

NEW DELHI (Reuters) - Two US senators have asked Indian Prime Minister Narendra Modi to soften India's position on the location of data, warning that the measures that require it represent "key trade barriers" between the two nations.

In a letter to Modi dated Friday and seen by Reuters, US Senators John Cornyn and Mark Warner, co-chairs of the Senate committee in India comprising more than 30 senators, urged India to adopt a regulatory framework of " soft touch "that allows data. flow freely across borders.

The letter comes when relations between Washington and New Delhi are strained by multiple problems, including an Indo-Russian defense contract, India's new tariffs on electronic products and other items, and their moves to buy Iran's oil despite the next US sanctions UU

Global payment companies, including MasterCard, Visa and American Express, have been pressuring the Ministry of Finance of India and the Reserve Bank of India to relax the proposed rules that require all payment data from national transactions in India they are stored inside the country before October 15.

Most likely, the letter is a final effort after the RBI told the officials of the main payment firms this week that the central bank would implement, in its entirety, its data localization directive without extending the deadline, or allow data to be stored both offshore and locally - a practice known as data duplication.

"We see this (the location of data) as a fundamental issue for further development of digital commerce and one that is crucial to our economic partnership," said the US senators. UU In the letter that was not previously reported.

Modi's office did not immediately respond to an email for comments.

Location push

Apart from the RBI proposal, India is working on a general data protection law that requires the storage of all critical personal data in India. Electronic commerce and cloud computing policies are also being developed.

The letter also raised concerns about the data protection bill and the e-commerce policy framework that required strict localization measures.

These measures have baffled some technology companies that fear they will increase their infrastructure costs, affect their global fraud detection analytics platforms and affect planned investments in India at a time when more and more Indians are connecting and using digital payments. .

US lobbyists, who represent companies such as Facebook Inc., Amazon.com and Google, owned by Alphabet Inc., have also expressed concern about the proposals.

Shamika Ravi, a member of Modi's economic advisory board, had earlier told Reuters that the moves were for the "long-term strategic and economic interest" of the country.

The senators added that any concern related to "protection and security," as well as access to data for legal purposes, was possible without restrictions on physical location, according to the letter.

However, government sources have previously told Reuters that stringent data-location measures were essential to obtain easier access to data during investigations.

The measures in India come at a time when countries around the world are announcing strict rules to regulate the way companies store data and protect privacy, following the Cambridge Analytica scandal on Facebook.
