The family of an unarmed black man who was shot and killed in his own apartment by a former Dallas white police officer filed a federal lawsuit Friday.


The lawsuit alleges that Amber Guyger used excessive force when he shot Botham Jean, a 26-year-old Santa Lucia native, inside his apartment on Sept. 6. and he thought he had met an intruder.


Guyger and the city of Dallas are named as defendants in the lawsuit. Jean's parents, Bertrum Jean and Allison Jean, are listed as plaintiffs.


Guyger was arrested and charged with involuntary manslaughter days after the shooting and has since been fired from the Dallas Police Department. The lawsuit alleges that the department did not adequately train Guyger, who had finished his shift before the shooting.


The lawsuit alleges that Guyger was acting within his reach as a Dallas officer during the deadly encounter.


"Officer Guyger was poorly trained and, as a result, failed to comply with DPD's flawed policy: use lethal force even when there is no immediate threat of harm to themselves or others," the lawsuit said.


There are still conflicting narratives about what led to the deadly shooting.


An affidavit prepared by the Texas Rangers said Guyger went to the wrong department after finishing his shift on September 6. The door, according to the document, was ajar and Guyger opened it.


Inside, the lights were off and a figure in the darkness cast a large silhouette across the room, according to Guyger. She said she thought her apartment was being stolen and gave verbal commands to the person, who ignored them.


He then pulled out his gun and fired twice, hitting Jean once in the torso, according to the affidavit. The lawsuit said Guyger did not give Jean emergency help after the shooting.


Lee Merritt, one of the lawyers for Jean's family, questioned Guyger's narrative. Merritt has said that two independent witnesses told him that they heard the knocking on the door in the hallway before the shooting.


He said a witness said he heard the voice of a woman who said: "Let me in! Let me in!"


On Friday, Dallas police refused to comment on the lawsuit, as did Guyger's criminal lawyer, Robert Rogers.


Jean was not the first person shot by the former officer.


Gugyer shot and wounded Uvaldo Pérez, on May 12, 2017, while on duty. An affidavit in the case filed against Pérez said the police were looking for a suspect when they called Guyger and another officer to help a third party. Perez got out of a car and became combative with Guyger and another officer.


He started a fight and opened fire after Perez snatched his Taser.


According to the lawsuit filed on Friday, Guyger was not required to receive mental counseling after the shooting in 2017, in which she was not charged.
