Americans say health care is a major concern in Tuesday's election, and voters say they trust Democrats over Republicans by double-digit margins. However, the Trump Administration has put together an impressive array of reforms that allow consumers more freedom and personal choices, not that they read it anywhere else.

Last month, the Trump Administration implemented a rule on health reimbursement agreements that would allow employers to offer workers tax-exempt dollars to buy insurance in the individual market. The Obama Administration banned this through regulation as part of the Affordable Care Act.


The thinking of the Administration is that these agreements will be more attractive for small businesses that lack the economies of scale that make the supply of insurance affordable. About 30% of workers in companies with three to 24 employees are covered by employer health benefits, compared to 44% in 2010, according to the Kaiser Family Foundation. Eight out of 10 companies with fewer than 200 employees offer only one plan.


Health reimbursements would be a cheap and easy option for, for example, new companies. This is also a way to offer more people the tax exemption on health care that the employer's insurance receives. Ending this economic distortion for everyone would be preferable, but equal treatment is a step forward.

The Democratic response is that this is another effort to undermine the Affordable Care Act, but they need a new script. The rule will attract more young and healthy workers to the individual market, which is currently leaning towards the sick or the poor who are eligible to receive tax credit subsidies. Refunds should make the ObamaCare exchanges. Plus Stable, which is what Democrats claim to want.


The rule includes handrails to prevent employers from placing sick employees in exchanges and to prevent a person from receiving both employer contributions and public subsidies. The Administration expects some 800,000 employers to provide reimbursement agreements to more than 10 million employees. Some three million will have been buying coverage in the individual market, which means that the rule should save money in increasingly expensive tax credits.


By not repealing ObamaCare, Republicans can not address all their dysfunctions. But on the sidelines, by expanding the options, they are improving the individual market, not getting worse, even when the Democrats accuse them of sabotaging ObamaCare. Other new Trump options include short-term plans and health plans of the association. And unlike ObamaCare, the government is not forcing you to buy these products.

Speaking of partnership plans, the returns are coming in the Democratic claim that allowing employers to join to offer coverage is a "junk insurance." The plans are still incipient, but notice what the Las Vegas Metro Chamber of Commerce offers: nine plan elections; Dental, vision and life coverage available; pre-existing conditions covered; and more, with premium rates blocked for two years.


This is not a surprise. The point of sale of partnership plans is that companies can group risk and reduce overhead. Companies want to offer generous coverage that helps attract workers in a tight job market.


There can also be more relief with the recent announcement that Health and Human Services has annulled a 2015 guide to exemptions under Section 1332. This is the waiver process of the Affordable Care Act for states to opt for. for not being part of the law. But the Democrats designed the exemptions to ensure that only progressive fantasies like the single payer in Vermont could win approval. The Obama crowd then restricted the statute even more in regulation.


The law stipulates that exemptions must show that the state plan provides coverage that is at least comprehensive and at least as affordable for a comparable number of residents. Oh, and make the budget neutral.


The Trump Administration will interpret this more rationally, compared to the Obama guide that applied the standards to how the plans would affect subpopulations in the state. The orientation was so prescriptive that most states did not bother to invent ideas. The question now is how many entrepreneurial Governors will decide that they can do better than the status quo even within the restrictions.

He has not heard about all this because the Democrats want to define the election as an option between them and the Republicans who supposedly want to deny insurance to people with lung cancer. But political control of health insurance is not the only way to care for the sick. The GOP tends to favor global subsidies for high-risk groups that subsidize those who need help paying for expensive treatments.


ObamaCare established a high-risk interim group to cover anyone with pre-existing conditions who were denied coverage, at least until the exchanges were launched. Peak of enrollment: 115,000, even when Democrats now claim that 130 million people have pre-existing conditions and are at risk from Republican politics.


The Republican Party's incremental progress in freedom of health care would have been hard to imagine a year ago when it could not repeal and replace ObamaCare. The repeal is still desirable given the fundamental defects of the law. But the Administration is working within the limits of the law to allow as much freedom as possible. If these products become popular, it may be more difficult for Democrats to eliminate the options of defending a single payer.
